RE: PETITION FOR THE DECOLONIZATION OF THE BANGSAMORO HOMELAND IN SOUTHERN PHILIPPINES, AND REQUEST FOR UNITED NATIONS ASSISTANCE IN ITS ESTABLISHMENT AS THE INDEPENDENT BANGSAMORO REPUBLIC OF MINDANAO

Dear Mr. Secretary General:


His EXCELLENCY PROF. NUR P. MISUARI, Chairman of the Moro National Liberation Front (MNLF) and President of the proposed Bangsamoro Republic of Mindanao, through the undersigned counsel, unto His Excellency Kofi Annan, Secretary General of the United Nations, most respectfully prays for the decolonization of Mindanao in order to enable and empower the oppressed Bangsamoro People to fully regain their sovereignty and independence pursuant to the mandate of the International Covenant On Civil and Political Rights, the Universal Declaration of Human Rights, and the inherent right of a people to shape and chart their own destiny.


I.  BRIEF STATEMENT OF THE FACTS

1. Historically, Mindanao -- hereinafter referred to as the Bangsamoro Homeland of Mindanao, Southern Philippines -- has never been truly a part of the colonial Republic of the Philippines. The records will show that at different times both the Spanish Crown and the American Empire had dealt with the Mindanaoans as an independent and sovereign people. If at all, the  Bangsamoro Homeland of Mindanao was placed under the administration of the colonial Republic of the Philippines, which was, and still is, indisputably a political puppet, if not a political clone,  of the United States of America. For centuries, the Bangsamoro Homeland was ruled by a chain of sovereign and independent sultanates recognized as such by the Chinese Empire, the United Kingdom, and even by the Crown of Spain and the United States of America.

     From 1521 to 1898, the Philippines was colonized by Spain, except most of  the Bangsamoro  Homeland of Mindanao which was ruled by several sovereign Sultans who were fiercely independent and, occasionally, entered into treaties with Spain and, subsequently, with the United States.

     From December 10, 1898 to July 4, 1946, the American Empire took over the colonization of the Philippines but, like its predecessor, it failed to exercise political authority over most of Mindanao, despite a series of American-sponsored genocide at Mount Dajo and Bud Bagsac, in Sulu Archipelago.

     From July 4, 1946 to the present, the Republic of the Philippines -- based in Manila and still controlled by its foreign predecessors -- took over the colonization of the Bangsamoro Homeland. This time, and given the fact that the new colonizers were also of the Malay race, the Bangsamoro People of Mindanao, tried in good faith to cooperate with the new government.

2. Politically, however, the Mindanaoans were hardly given any reasonable amount of participatory responsibility in nation building. More than 90 per cent of those running the government were, and still are, non-Mindanaoans.  Of the more or less 150 Filipinos elected to the Senate, only more or less 15 hailed from Mindanao. To date, no Mindanaoan has been elected President or appointed Chief Justice of the Supreme Court or commissioned Chief of Staff of the Armed Forces of the Philippines. In a word, the Mindanaoans became second-class citizens in the new colonial republic contrary to the provision of Article 21 of the Universal Declaration of Human rights which states that "Everyone has the right to take part in the government of his country, directly or through freely chosen representatives."

3. Ideologically, the Philippine Government could therefore be aptly described as "money-talk-cratic:" a place where money talks and where even moneyed basketball players, comedians, movie actors and brainless personalities -- however corrupt, dumb, unschooled and unskilled in the art of leadership --  could be in control of the government. Consequently, the Philippine government, like the "King of Inequities" (Spain's King Philip II) after whom it is named, has become incorrigibly immoral, hopelessly dishonest and deceitful. According to the United Nations International Monetary Fund (IMF) and the Philippine Ombudsman, it is the 4th most corrupt country in the world, although highly reliable sources say is in fact the number one most rotten and diabolic societal system ever known to man and, as such, a supreme disgrace to the world community.

4. Spiritually, the Philippine government, which is heavily dominated by "Christians," is controlled by indisputably hypocritical and inhuman personalities. Whereas Christ's Second Commandment calls for every human being to "love his neighbor as he loves himself," most of those in control of the government are only interested in their personal aggrandizement. They equate their self-interest with the "truth" albeit self-interest standing by itself is most often not consistent with the wellbeing of others. Thus the leadership of the colonial Republic of the Philippines has been "un-Christianly" biased against the Bangsamoro People of Mindanao.

5. Having been forced to live in the midst of these harsh, ethnically discriminatory,  corrupting and dehumanizing realities, the Bangsamoro People of Mindanao wanted to REGAIN their lost sovereignty or political independence. Thus, with the generous assistance of other Muslim nations - i.e, The Organization of The Islamic Conference OIC) --  the fiercely freedom-loving Malayans of Mindanao gallantly responded to the challenge of the time and formed the Moro National Liberation Front (MNLF), the Moro Islamic Liberation Front, and several other movement for Mindanaoan independence aimed at aborting the genocidal policy of the colonial Republic of the Philippines towards the freedom-loving people of Mindanao.

6. Recognizing the validity of its cause and the nobility of its vision, The Organization of the Islamic Conference (OIC), conferred upon the Moro National Liberation Front (MNLF)  a Permanent Observer Status under the leadership of its founder and chairman, His Excellency Prof. Nur P. Misuari, thereby forcing the Philippine Government to negotiate on the table of peace, rather than violently pursuing its anti-Muslim genocidal policy of physical extermination and political exclusion. In 1976, the OIC, the Government of the Philippines (GRP), and the Moro National Liberation Front (MNLF), entered into what became known as the "Tripoli Agreement," a trilateral covenant which calls upon the Republic of the Philippines to give a meaningful autonomy to the Bangsamoro People of Mindanao. However, and because of bad faith and insincerity, the OIC-GRP-MNLF compact failed because it turned out that at all times the GRP only wanted to manipulate and weaken the resolve of the Bangsamoro  People to REGAIN their freedom and liberty. Like the Crown of Spain and the American Empire, the GRP played one Muslim group against another and, at the same time, fanned the flame of feuding Muslim factions and families. Moro revolutionary commanders who were morally weak and spiritually corruptible were bought and bribed into submission and silence. While those who continued to tenaciously pursue their demand for independence have been discredited as international "terrorists" or "secessionists" or "separatists" and, worst, maliciously charged as just as corrupt as the ruling GRP leadership.

7. Meanwhile, tens of thousands of Mindanaoans died in countless fields of combat, as thousands fled to neighboring islands and countries, like Malaysia and Indonesia. To minimize its casualties, the GRP exploited the ignorance of many Christian Mindanaoans and used them to crush the Bangsamoro freedom fighters. In some places or instances, the GRP succeeded  into making the Christians and Muslims literally ate each other to express their hatred and show their bravery. While in other places, Christians and Muslims bonded and fought side by side against the GRP colonizers, united in the thought that --  aside from their different religious affiliations - they were and still are also Malays, and direct descendants of the old but great Malayan Sultanates and Empires.

8. Viewed against the backdrop of foregoing narration of facts, the MNLF -- being the sole representative of the more or less 20 million Bangsamoro People of Mindanao, Southern Philippines to The Organization of the Islamic Conference (OIC) and the world community -- desires to present its struggle for independence or decolonization directly to the members of the United Nations for their consideration and support, more particularly  the United Nations Special Committee on Decolonization.

9. This is because  Bangsamoro People of Mindanao, Southern Philippines, are part of the global community and, as such, they should be accorded their inalienable right to regain their sovereignty or independence which they enjoyed for hundreds of years as shown by recorded international agreements they entered into with the Chinese Empire, the Dutch government, the United Kingdom, and even with Crown of Spain and the United States of America.

10. To date, the Bangsamoro People of Mindanao are still being brutally oppressed, ruthlessly exploited, physically exterminated and politically excluded from the governance of the nation by the colonial Manila-based Philippine Government, which has been ranked by the United Nations' International Monetary Fund (IMF) and the Philippine Ombudsman as the 4th most corrupt institution or country in the world.

11. Since the birth of the Philippine Republic, the Bangsamoro People have never been accorded a meaningful participatory responsibility in shaping the destiny of the country as shown by the fact that no Mindanaoan has ever been elected President or appointed Chief Justice of the Supreme Court or commissioned Chief of Staff of the Armed Forces of the Philippines. In short, the Mindanaoans have been a victim of egregious ethnic and religious discrimination and, under the circumstances, the only way for them to live as human beings is to regain their lost sovereignty or independence.

12. To suppress the Mindanaoan struggle for independence, the Philippine Government has methodically implemented a policy of ethnic cleansing. More particularly, the Bangsamoro People have been either physically exterminated or politically excluded from the governance of the country. And, to date, tens of thousands of the Bangsamoro People have become victims of depopulation campaign.


II. THE NEED FOR DECOLONIZATION
     AND POLITICAL INDEPENDENCE


TO SAVE THE MINDANAOAN PEOPLE FROM SUFFERING AND FROM THE UGLY SCOURGE OF WAR AND FROM FURTHER LOSS OF LIVES BROUGHT ABOUT BY THE GOVERNMENT OF THE REPUBLIC OF THE PHILIPPINES' (GRP'S) GENOCIDAL SOLUTION TOWARD THE MINDANAOAN CLAMOR TO REGAIN THEIR SOVEREIGNTY AND INDEPENDENCE, the Moro National Liberation Front (MNLF), under the leadership of his Excellency Prof. Nur P. Misuari, most prayerfully seeks your assistance  in bringing about the decolonization of the Mindanaoan people and in regaining their collective right to self-determination based on the following international covenant and resolution:

1. Part 1, Article 1 of the International Covenant On Civil and Political Rights which provides: "All peoples have the right to self-determination. By virtue of that right they freely determine their political status and freely pursue their economic, social and cultural development."

2. Part 11, Article 2, of the International Covenant On Civil and Political Rights which provides: "Each party to the present Covenant undertakes to take steps, individually and through international assistance and cooperation, especially economic and technical, to the maximum of its available resources with the view to achieving progressively the full realization of the rights recognized in the present Covenant by all appropriate means, including the adoption of legislative measures.

3. The Plan of Action for the Full Implementation of the Declaration on the Granting of Independence to Colonial Countries and Peoples which, among others, states: "Member States shall render al necessary moral and material assistance to the peoples under colonial domination in their struggle to exercise their right to self-determination and independence."

Should there be further requirements needed for the Mindanaoans to rise to a level of decolonization and, eventually, to a sovereign status of membership in the United Nations, the Moro National Liberation Front (MNLF) is willing to comply with any or all said requirements, and appear before any U.N. panel -- especially before the United Nations Special Committee on Decolonization -- tasked with the responsibility of determining the eligibility of the Bangsamoro People of Mindanao for decolonization and independence.


III.  PRAYER IN BEHALF OF THE MORO NATIONAL LIBERATION FRONT (MNLF) AND THE PROPOSED BANGSAMORO REPUBLIC OF MINDANAO

In view of the above and foregoing, His Excellency Prof. Nur P. Misuari most respectfully and urgently prays that, given the urgency of this petition, the Honorable Secretary General of the United Nations take the following humanitarian actions:

1. That the Honorable UN Secretary  General  refers this matter to the Members of the Special Committee on Decolonization for examination, suggestions, and recommendations, including all other United Nations committees dealing with decolonization and fundamental human rights.

2. That the Honorable Secretary General recommends that the Moro National Liberation Front (MNLF) and the officers of the proposed Bangsamoro Republik of Mindanao be permitted to meet the members of the Special Committee on Decolonization and give them all the opportunity to present their views concerning the urgent need to regain the sovereignty and independence of the Mindanaoan people.

3. That the Honorable UN Secretary General refers this petition to the UN Commissioner of Human Rights to determine the extent of GRP's genocidal policy against the Bangsamoro People; and

4. That the Honorable Secretary General considers the possibility of using international prosecutorial agencies to charge the administration of Madam Gloria Macapagal Arroyo with the crime of genocide against the Mindanaoan People.

Enclosed is a draft of the Bangsamoro People's proposed Declaration of Independence for your review, suggestions, and recommendations.

Your favorable action on this extremely urgent request will be highly and gratefully appreciated by the Bangsamoro People of Mindanao.
